Maya Membership Terms

These Membership Terms govern Maya's membership program. They supplement the Maya Terms of Service and, in the event of any conflict regarding membership-specific matters, these terms control.
1. What the Membership Program Is
Maya's membership program is a community-based program that rewards members for participating in the Maya community. The program is structured in tiers. As members accumulate points through community activities, they advance through tiers, and each tier entitles the member to progressively greater discounts on purchases from Maya.
The membership program has three tiers:
- Arbitrage (basic tier, the default for all members): Available to all members at no cost. Entitles members to the base level of access to Maya's services and purchases;
- Concierge (intermediate tier): Unlocked by accumulating sufficient points. Entitles members to enhanced discounts on Maya products and pricing recommendation reports;
- Top Tier: Unlocked by accumulating the highest threshold of points. Entitles members to the maximum discount level, which may reduce the cost of certain products and reports to zero.
Specific point thresholds for each tier are communicated within the service and may be updated from time to time.
2. How to Become a Member
Membership begins when you opt in for the first time by:
- Providing your contact information (phone number or other supported contact method) through a supported messaging channel or the Maya website;
- Accepting the Maya Terms of Service.
A person who uses the Maya website or web chat without providing contact information and accepting the Terms is a "website user," not a member. Website users may browse Maya's public content but are not enrolled in the membership program and are not entitled to member discounts.
Any person may purchase Maya products and pricing recommendation reports at standard (non-discounted) prices without being a member. Membership is not required to transact with Maya.
3. How Points Are Earned
Members earn points through the following voluntary community activities:
Purchases: Members earn points by purchasing products or pricing recommendation reports from Maya. The number of points earned per purchase is displayed at the time of purchase and may vary by product type and price.
Price sharing: Members earn points by sharing pricing data with the Maya community. This includes:
- Submitting receipts from purchases made at third-party retailers;
- Submitting photographs of prices from physical store locations;
- Other forms of community price contribution as communicated within the service.
Referrals: Members earn points by referring new members to Maya. When a member refers someone who subsequently registers as a member and opts in, the referring member earns points equal to 20% of the points accumulated by the referred member during that referred member's first 12 months on the platform. Referral point credits are applied on a rolling basis as the referred member earns points, not as a lump sum in advance.
Points earned through any of these activities are credited to the member's account and accumulate toward membership status tier thresholds.
4. Points Have No Monetary Value
This section is critical. Please read it carefully.
Points in Maya's membership program have no monetary value of any kind. The following applies absolutely and without exception:
- Points are not property;
- Points are not cash, currency, or any form of cash equivalent;
- Points cannot be transferred, sold, gifted, assigned, or conveyed to another person in any manner;
- Points cannot be redeemed for cash or any cash equivalent under any circumstances;
- Points do not represent any debt, obligation, or liability of Maya Verdant, LLC;
- Points cannot be inherited, bequeathed, or transferred upon a member's death or incapacity;
- Points have no value outside the Maya platform and cannot be used on any third-party platform;
- Points expire and are forfeited upon account closure or termination for cause.
The activities that members perform to earn points are voluntary community contributions, not compensated work or services. When a member submits a receipt, shares a price, or refers a friend, that activity is a contribution to the Maya community and carries no expectation of payment, compensation, or economic benefit of any kind. The points that result from those activities are a tracking mechanism only; they measure community participation for the sole purpose of determining membership status tier.
Membership status, not points, is what entitles a member to discounts. The accumulation of points to a threshold unlocks a membership status tier. It is the status tier, as a recognized level of community participation, that entitles the member to purchase discounts on Maya products and reports. Points are the measure; status is the benefit. This distinction is intentional and meaningful.
Discounts are not the purchase of points. When a member with sufficient status receives a discount on a Maya product or report, that discount is a benefit of their membership status. It is not a redemption of points for cash value, and it does not reflect any fair market value of the activities that earned the points.
5. How Membership Status Works
Membership status is determined by a member's cumulative point total. When a member's point total reaches the threshold for a higher tier, their status is upgraded automatically. Status is maintained as long as the member's account remains active and in good standing.
Tier thresholds and discount levels are communicated within the service and may be updated from time to time with advance notice to members. Maya will not reduce existing members' discount levels without providing at least 30 days' advance notice via the member's registered contact method.
Discounts are applied at checkout on eligible purchases. The checkout page will display the applicable discount and the final price before the member confirms the transaction. For members with sufficient status on eligible products or reports, the final price may be zero.
Non-members and members who have not yet reached a discount-eligible tier may purchase any Maya product or pricing recommendation report at the standard (non-discounted) price. Membership status is not required to transact with Maya.
6. Referral Program Details
Members may refer others to Maya through Maya's referral program. The following terms apply:
- A referral is credited when the referred person registers as a new Maya member and opts in for the first time using the referring member's referral code or link;
- The referring member earns points equal to 20% of the points accumulated by the referred member during the referred member's first 12 months on the platform;
- Referral points are credited on a rolling basis as the referred member earns their own points;
- A referred member may also participate in the referral program and refer others; this does not affect the original referring member's referral earnings;
- Referral codes and links are personal and non-transferable. Selling, distributing, or publicly posting referral codes in a manner designed to game point accumulation is prohibited;
- Maya reserves the right to audit referral activity and to cancel or reverse referral point credits if the referral was generated through prohibited means.
7. What Is Prohibited in the Membership Program
The following activities are prohibited and may result in immediate suspension or termination of membership status, forfeiture of all accumulated points, and prohibition from future participation in the membership program:
- Submitting false, fabricated, or altered receipts or price data;
- Creating multiple accounts for the purpose of accumulating points or earning referral credits across accounts;
- Using automated tools or bots to submit price data or generate referral activity;
- Selling, purchasing, or transferring referral codes or links for consideration of any kind;
- Circumventing the referral system by referring the same person multiple times, creating fake accounts as referred members, or similar manipulation;
- Attempting to reverse engineer or exploit the point-calculation system;
- Using membership discounts in connection with transactions that are later disputed, reversed, or cancelled in bad faith;
- Any activity designed to inflate point totals or tier status through means not contemplated by the program.
8. Maya's Rights Regarding Membership Status
Points and membership status are not vested rights. Maya Verdant, LLC reserves the right to:
- Audit any member's point-earning activity and reverse credits found to have been earned through prohibited means;
- Suspend or terminate a member's account and membership status for violations of these Membership Terms or the Maya Terms of Service;
- Modify the point thresholds, tier structure, discount levels, or eligible products at any time, with advance notice to members for material changes;
- Discontinue the membership program entirely with 60 days' advance notice to active members;
- Interpret these Membership Terms and apply them to situations not expressly covered, with the goal of fair and consistent administration.
Upon account termination for cause, all accumulated points and membership status are forfeited without compensation.
9. Tax Disclosure
Maya does not believe that points in the membership program have reportable taxable value under applicable tax law, because: (a) points have no monetary value; (b) points cannot be redeemed for cash or cash equivalents; (c) the activities that earn points are voluntary community contributions, not compensated services or employment; and (d) discounts applied at checkout reduce the purchase price paid, not create income.
However, tax law is complex and varies by jurisdiction. Maya does not provide tax advice. Each member is solely responsible for their own tax compliance and reporting obligations. Members who have questions about the tax treatment of their membership activities, point accumulation, or discount-adjusted purchase prices should consult a qualified tax advisor in their jurisdiction.
Maya makes no representation or warranty about the tax treatment of membership activities or discounts in any jurisdiction.
10. Updates to These Terms
Maya may update these Membership Terms from time to time. When updated, Maya will update the "Last Updated" date at the top. For material changes that reduce existing member benefits, Maya will provide at least 30 days' advance notice via the member's registered contact method.
Your continued participation in the membership program after updated terms take effect means you accept the changes. If you do not agree, you may opt out of the membership program by contacting [email protected]. Opting out of the membership program does not close your Maya account; you may continue to transact with Maya at standard prices.
