Welcome to Maya. These Terms of Service ("Terms") govern your use of Maya's services. By texting Maya, visiting our website, or otherwise interacting with our services, you're agreeing to these Terms. Please read them — they're written in plain English.
Quick summary: Maya is a household buying assistant. We find deals, buy and sell devices directly, fulfill pet food orders, and deliver optimized grocery shopping plans — primarily over SMS. Some services are free (cell plan recommendations); others involve direct purchase transactions where Maya is the seller. US users: disputes go to arbitration with a class action waiver (Section 18). Non-US users: see your Jurisdiction Specific Terms.
This agreement includes the following documents:
- These General Terms — the core terms governing your use of Maya
- Product Specific Terms — fees and mechanics for each service (devices, cell plans, groceries, pet food)
- Jurisdiction Specific Terms — additional terms based on your location, including governing law and any local consumer rights
- Privacy Policy — how we collect and use your data
- Data Processing Agreement — data processing terms for business customers when Maya processes personal data on your behalf

- AI Processing Policy — how Maya uses AI and your rights
In the event of any conflict, the order of precedence is: Jurisdiction Specific Terms → Product Specific Terms → these General Terms.
1. Who We Are
Maya Verdant, LLC ("Maya," "we," "us," "our") operates a household buying assistant service. Our primary interface is SMS text messaging, accessible at +1 (800) 629-2658. We also operate the websites at maya.markets and associated subdomains.
Maya is a free service for consumers. We earn revenue through referral fees and transaction processing fees — described in Section 10.
2. Accepting These Terms
You accept these Terms when you:
- Text Maya's number
- Create an account or register on any Maya website
- Use any Maya product or service
You must be at least 18 years old to use Maya. By accepting, you confirm you meet this requirement.
If you're using Maya on behalf of a business, you confirm you have authority to bind that business to these Terms.
3. What Maya Does
Maya is a household buying assistant that operates in two modes depending on the service:
Direct commerce — For devices and pet food, Maya acts as the merchant. Maya purchases devices from you, sells devices to you, and fulfills pet food orders directly. In these transactions, Maya is the buyer or seller and you have the rights of a customer purchasing from a retailer.
Referral and comparison — For cell plans and certain other services, Maya finds better options and refers you to third-party carriers or vendors to complete the transaction. Maya earns a referral fee in these cases.
Advisory services — Maya sells optimized shopping plans (such as a grocery savings plan) that are information products. These are Maya's recommendations for how to allocate your shopping across stores for maximum savings.
Across all services, Maya:
- Uses AI to analyze your needs and find better deals
- Monitors the market and proactively alerts you to savings
- Handles logistics for direct transactions (device trade-ins, fulfillment)
What Maya does not do regardless of service type:
- Act as your legal, financial, or professional advisor
- Make purchases or sign up for services on your behalf without your explicit approval
- Guarantee any specific outcome, price, or availability
4. SMS Consent and Communications
Read this section if you text Maya — it's important.
By texting Maya or providing your phone number for Maya communications, you expressly consent to receive text messages (SMS/MMS) from Maya Verdant, LLC, including:
- Service messages and confirmations
- Deal alerts and upgrade recommendations
- Account-related notifications
Message frequency varies based on your usage and available deals. Standard message and data rates from your carrier may apply.
To opt out: Reply STOP to any Maya message. You'll receive one confirmation, then no further messages. You can re-subscribe at any time by texting START.
For help: Reply HELP or email [email protected].
Opting out of SMS stops Maya's messages but does not delete your account or data. See our Privacy Policy for data deletion requests.
Maya uses Telnyx, LLC to deliver SMS messages. Your carrier is not responsible for delayed or undelivered messages.
TCPA Compliance: Your consent to receive SMS messages is not a condition of purchasing any product or service. You can use Maya's website and other non-SMS channels without opting into SMS communications.
5. Your Account
Maya creates a member profile tied to your phone number. You agree to:
- Provide accurate information when asked (name, address, device details, preferences)
- Keep your contact information current
- Keep your account access personal — don't let others use your Maya session
Maya reserves the right to suspend or close accounts that are inactive, used fraudulently, or in violation of these Terms.
6. Maya's Services in Detail
6.1 Device Upgrade Recommendations
When you share your current device with Maya, we'll periodically review its approximate market value and identify upgrade options that could benefit you. These are Upgrade Recommendations — not purchase commitments.
A Device Assessment is Maya's estimate of your device's condition and likely resale value, based on information you provide. This is an estimate only. Actual resale or trade-in values offered by third-party buyers may differ based on physical inspection, market conditions, and buyer policies.
If you believe an assessment is inaccurate, you can dispute it by contacting [email protected].
6.2 Cell Plan Recommendations
Maya compares your current wireless plan against available alternatives and alerts you when a better-value plan is available. Plan terms, pricing, and availability are determined entirely by carriers and may change without notice. Maya's recommendation reflects data available at the time — verify current terms directly with the carrier before switching.
6.3 Grocery and Everyday Deals
Maya monitors prices on groceries and household items at participating retailers and alerts you to meaningful savings. Prices, promotions, and product availability are controlled by retailers and may change at any time.
6.4 Pet Food and Other Categories
Maya also finds deals on pet food, home services, insurance, and other categories as they become available. The same advisory-only, no-guarantee principles apply across all verticals.
7. Maya as Seller vs. Maya as Referral
The nature of Maya's role depends on the service:
Maya is the seller for device transactions and pet food orders. When you buy a device from Maya, sell your device to Maya, or place a pet food order through Maya, you are transacting directly with Maya Verdant, LLC. In these transactions:
- Maya holds title to goods during the transaction
- Maya is responsible for order accuracy, fulfillment, and applicable warranties
- Your consumer rights apply as if purchasing from any retailer
- Maya's Product Specific Terms govern these transactions, including return and refund terms
Maya is a referral intermediary for cell plan recommendations and similar comparison services. When you follow a recommendation to a third-party carrier or vendor:
- You enter into a direct agreement with that third party
- Maya is not a party to that contract and is not responsible for the vendor's pricing, service quality, or terms
- Maya earns a referral fee from the vendor
Maya sells advisory products for services like the grocery savings plan. These are information products — Maya's analysis and recommendations for how to optimize your shopping. The plan is Maya's product; the actual grocery purchases are yours to make independently at retailers of your choice.
In all cases, Maya does not act as your legal, financial, or professional advisor. Maya's recommendations are suggestions based on available data and do not substitute for your own judgment.
8. AI Processing Disclosure
Maya uses artificial intelligence — including large language models — to understand your messages, personalize your experience, and generate recommendations.
You acknowledge and agree that:
- AI-generated content may contain errors, omissions, or outdated information
- AI recommendations are not professional advice of any kind
- Maya cannot guarantee the accuracy, completeness, or suitability of AI-generated output
- Conversations with Maya are processed by AI systems that may retain and analyze your messages (see Privacy Policy)
By using Maya, you consent to AI processing of your communications and data as described in our Privacy Policy.
Maya is not an emergency, crisis, medical, legal, or counseling service. Maya does not monitor your messages for emergencies and may not see, understand, or respond to an urgent situation. If you or someone else may be in danger, contact 911, or the 988 Suicide & Crisis Lifeline (call or text 988). Any safety resource, hotline, or crisis number Maya surfaces is provided for your convenience only and is not a substitute for emergency services or professional help.
Points, unlockable deal analysis, and authorization to debit points
Some Maya responses are delivered using membership points (or similarly labeled account credits). When you send Maya an emoji command, keyword, or any text message that requests personalized deal analysis, comparisons, savings estimates, or other tailored outputs that Maya offers to unlock in exchange for points (collectively, "Deal Analysis"), you agree that Maya may:
- Prepare a response that states the number of points required to unlock the full answer and your current point balance
- Only after you clearly confirm that you want to proceed — for example by selecting a confirmation option Maya presents or by replying with yes, OK, or another affirmative Maya accepts for that specific prompt — debit that number of points from your account and send you the unlocked answer
If you do not confirm, no points are debited for that unlock. The same rule applies whether you use an emoji shortcut or plain-language text that requests the same Deal Analysis.
Points are not refunded for price inaccuracies: Once points are debited for Deal Analysis, Maya does not automatically restore them because a shown price was wrong, a store price differed, a deal expired, or savings did not materialize. Maya uses community-backed pricing that can be stale or incorrect. See Product Specific Terms — Section 0 for the full policy, including discretionary goodwill credits.
Separate from direct purchases: If you complete a separate purchase or payment (for example a checkout for physical goods), that payment is not a point debit under this subsection and is governed by the applicable product, invoice, or checkout terms.
Points you earn, points you buy, and Maya's discretion
You may also earn points for community contributions (such as Submissions) and purchase point packs. All points — earned, purchased, granted, or held — are governed by these Terms and the Membership Terms, which control how points are valued, awarded, held, expired, and forfeited. You acknowledge and agree that:
- Points are not money, currency, stored value, property, or a security, have no cash value, are non-transferable, and are a limited, revocable license to access certain Maya features;
- Maya sets and may change, in its sole discretion and at any time, all point values, earn formulas, eligibility, caps, holds, expiration, and the program itself, including suspending or discontinuing earning or the program, subject to applicable law;
- Earned points are conditional. Maya may withhold, delay, hold pending verification or corroboration, reduce, reverse, or forfeit points — including before or after they appear in your balance — where a contribution is unverified, duplicative, stale, ineligible, or where Maya suspects fraud, gaming, manipulation, or any violation of Section 12. Some earned points may be held and may never vest if they are not corroborated;
- Points expire as described in the Membership Terms, and are forfeited on account closure or termination for cause;
- You are solely responsible for any taxes arising from points or rewards. Maya may request a completed Form W-9 (or other tax information), withhold or suspend earning until you provide it, and issue IRS Form 1099 or other tax forms where Maya determines reporting is required; and
- Purchased point packs are a prepayment for access to Maya's own services. Purchased points do not expire. You may request a refund of your unused purchased points at any time; refunds are calculated at $0.004 per point (the points' value to you in services — not the price you paid to acquire them) and issued to your original payment method. The portion of your purchase above that value (the difference between what you paid and $0.004 per point) is non-refundable. Purchased points remain subject to the program's holding and forfeiture rules (for example, forfeiture for fraud or violation of these Terms) and to applicable unclaimed-property law.
Awarding or charging points for analysis does not guarantee any savings, price, or outcome.
9. Third-Party Vendors
Maya refers you to third-party vendors, carriers, retailers, lenders, and other service providers. Maya has no control over these parties and is not responsible for:
- Their pricing, product quality, availability, or service
- Any transaction you complete with them
- Their privacy practices, data handling, or terms of service
- Any dispute arising from a transaction with them
- Errors in the information they provide to Maya
Links and referrals to third-party services are provided for your convenience. They do not constitute Maya's endorsement of those parties. Always review a vendor's own terms and privacy policy before making a purchase or signing up.
10. BNPL and Financing Facilitation
Maya may facilitate access to buy-now-pay-later (BNPL) or short-term financing options in connection with device upgrades or purchases. Maya acts as a referral intermediary only. Maya is not a lender and does not make or approve financing decisions.
Financing offers are made by third-party lenders under their own terms, credit requirements, and applicable lending laws. If you access financing through Maya:
- Approval and terms are entirely at the lender's discretion
- You are solely responsible for all payment obligations, interest, and fees under the financing agreement
- Maya is not liable for any financing arrangement between you and a lender
- BNPL availability varies by state and transaction type
11. How Maya Earns Revenue
Maya's revenue model varies by service. We are transparent about how we make money because it's important you understand our incentives:
Device transactions (direct commerce): Maya buys your current device and sells you a replacement. Maya earns the spread between its purchase and sale prices, plus a 10% processing fee on the transaction value. The net cost to you is shown clearly before you confirm any transaction.
Pet food (direct commerce): Maya sources pet food directly and sells it to you. Maya earns a retail margin on the sale. You pay the listed price; there is no separate service fee.
Cell plan referrals: Maya earns a referral commission from carriers when you switch plans through a Maya recommendation. This service is free to you — the commission comes from the carrier, not from you.
Grocery savings plans (paid advisory service): Maya charges a fee for its optimized grocery shopping plans. The fee is disclosed and confirmed before you are charged.
In all cases, our incentive is to find you the best available outcome — better deals for you lead to more transactions for us.

12. Acceptable Use
You agree to use Maya only for lawful, personal, non-commercial purposes. You may not:
- Provide false, misleading, or fraudulent information to Maya or through Maya to vendors
- Submit any fabricated, staged, altered, AI-generated, duplicated, or otherwise inaccurate price, photo, receipt, store, or product, or report a price you did not personally observe
- Submit images you do not have the rights to, or that contain other people's faces, likenesses, or personal information, or that are obscene, abusive, or unlawful
- Manipulate, inflate, distort, or game the community price index, the points program, or any reward — including creating or reporting fake or non-existent stores or products, coordinating or colluding with others, using multiple or fake accounts, or bulk/automated submissions to earn points or affect prices
- Use Maya to harass, harm, or deceive other people
- Attempt to reverse-engineer, scrape, or exploit Maya's systems, AI models, or data
- Use Maya commercially without our written permission
- Repeatedly trigger SMS keywords (STOP, START, HELP) in bad faith
- Attempt to gain unauthorized access to Maya's systems or other users' accounts
- Use automated tools to interact with Maya without permission
Violating these rules may result in suspension or permanent termination of your access, removal of your Submissions, and the withholding, reversal, or forfeiture of points (including purchased points, to the extent permitted by law), in addition to any other remedy available to Maya. Maya determines violations in its sole discretion.
13. Intellectual Property
13.1 Maya's intellectual property
All content, trademarks, software, and technology on Maya's websites and in Maya's services belong to Maya Verdant, LLC or our licensors. Your use of Maya's services doesn't give you any ownership rights.
You may use Maya's services for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from any part of Maya's services without our written permission.

13.2 Your submissions — photos, receipts, and price reports
Maya lets you contribute information to the community, including photographs of price signs, pumps, shelf tags, and products; photographs or scans of receipts; barcodes; and typed or spoken price reports (collectively, "Submissions"). Submissions are voluntary.
You keep ownership of the original photo or receipt you submit. You grant Maya Verdant, LLC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, transferable, and sublicensable license to host, store, reproduce, modify, adapt, translate, create derivative works from, extract data from, publish, display, distribute, and otherwise use and commercially exploit your Submissions and any information derived from them, in any media and for any purpose connected with operating, improving, marketing, and commercializing Maya's services — including building, maintaining, and licensing price indexes and other data products. This license survives termination of your account and these Terms.
You waive any moral rights in the Submissions to the extent permitted by law, and you agree Maya is not required to attribute Submissions to you. Maya may keep, use, and license Submissions and derived data in de-identified or aggregated form indefinitely.
You will not receive any payment, royalty, or other compensation for a Submission or for Maya's use of it, except for any membership points Maya may choose to award under its program rules (Sections 8 and 11 and the Membership Terms), which are discretionary and may be withheld, reduced, reversed, or forfeited as those rules describe. A Submission is a community contribution, not work, employment, or a service performed for hire, and it creates no employment, agency, partnership, or independent-contractor relationship.
13.3 Community data and the price index
Maya exclusively owns all data, databases, indexes, statistics, analyses, and derivative works that Maya creates or derives from Submissions and from other sources — including the prices, products, locations, timestamps, and any aggregated or computed values that make up Maya's community price index (collectively, "Community Data"). As between you and Maya, Community Data is Maya's property, and you have no ownership or other rights in it. Nothing in these Terms transfers any Community Data to you.
13.4 Your representations about Submissions
Each time you make a Submission, you represent and warrant that:
- You have all rights necessary to submit it and to grant the license in Section 13.2;
- The Submission is truthful and accurately depicts a real, current price that you personally observed, and has not been fabricated, staged, altered, AI-generated, or manipulated;
- The Submission does not infringe or violate any third party's intellectual property, privacy, publicity, contract, or other rights;
- The Submission does not contain personal information of any other person, any identifiable person's face or likeness without that person's consent, or any confidential or proprietary information; and
- The Submission is not unlawful, obscene, harassing, defamatory, or otherwise in violation of Section 12.
13.5 Content standards, moderation, and reporting
Maya is not obligated to review, accept, use, publish, or retain any Submission, and may reject, remove, filter, de-prioritize, or refuse to credit any Submission in its sole discretion. Maya may record metadata about Submissions (including device, content, and technical fingerprints) to operate the service and detect abuse, as described in the Privacy Policy.
If you submit content that appears unlawful — including any apparent child sexual abuse material — Maya may remove it, preserve it, report it to law enforcement or the National Center for Missing & Exploited Children (NCMEC), and provide related information to authorities as required or permitted by law, and may suspend or terminate your account. Submitting obscene, abusive, or unlawful images is a serious violation of these Terms.
14. Privacy
Our Privacy Policy explains what personal information we collect, how we use it, and your rights. By using Maya, you agree to our Privacy Policy, which is incorporated into these Terms by reference.
15. Disclaimers of Warranty
For referral and advisory services (cell plans, AI recommendations, grocery savings plans), these services are provided "as is" and "as available." To the fullest extent permitted by applicable law, Maya disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Recommendations reflect information available when generated — prices and availability can change before you act.
For direct commerce transactions (devices and pet food), Maya warrants that:
- Devices are functional and match the described condition at time of shipment
- Pet food is within its manufacturer's stated shelf life and sealed/undamaged on arrival
- If a product does not meet these standards, Maya will replace it or issue a full refund as described in the Product Specific Terms
These direct commerce warranties are in addition to any non-waivable statutory warranties in your jurisdiction.
We do not warrant that:
- AI-generated recommendations are always accurate or optimal for your situation
- Third-party vendors' prices or service terms will remain as shown at the time of recommendation
- Maya's services will be uninterrupted or error-free at all times
Some jurisdictions don't allow certain warranty disclaimers. In those places, our disclaimers apply to the maximum extent permitted by law.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Maya Verdant, LLC and its officers, directors, employees, agents, and affiliates will not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, savings, or business opportunity
- Damages arising from your reliance on Maya's recommendations or AI-generated content
- Any transaction with a third-party vendor referred by Maya
- Service interruptions, downtime, or loss of access to Maya
- Errors in AI-generated recommendations or deal comparisons
In all cases, Maya's total cumulative liability to you will not exceed the greater of: (a) fees you actually paid to Maya in the 12 months before the claim arose, or (b) one hundred dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply only to the fullest extent permitted by law.
17. Indemnification
You agree to defend, indemnify, and hold harmless Maya Verdant, LLC and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of Maya's services
- Your violation of these Terms
- Your violation of any third party's rights
- Any transaction you enter into with a third-party vendor
- Any false or inaccurate information you provide to Maya
18. Mandatory Arbitration and Class Action Waiver
This section significantly affects your legal rights. Please read it carefully.
Scope: This Section 18 applies to users located in the United States. If you are located outside the United States, the dispute resolution terms in your Jurisdiction Specific Terms apply instead. In jurisdictions where mandatory arbitration or class action waivers are unenforceable under consumer protection law, this section does not apply to those disputes.
18.1 Agreement to Arbitrate
You and Maya Verdant, LLC ("Maya") agree that any dispute, claim, or controversy arising out of or relating to these Terms, Maya's services, or the relationship between us — including any question about whether a dispute is subject to arbitration — will be resolved exclusively by binding individual arbitration, not in court.
This arbitration agreement is governed by the Federal Arbitration Act (FAA), which applies regardless of any state law to the contrary.
18.2 Arbitration Rules and Process
Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at adr.org), or a mutually agreed alternative arbitral body.
Unless you and Maya agree otherwise, arbitration will take place in the county where you reside or by phone or video conference. The arbitrator may award any relief available in court on an individual basis. The arbitrator's decision is final and binding, subject to limited judicial review under the FAA.
Costs: Maya will pay AAA filing and administrative fees for arbitrations where your claim is $10,000 or less, unless the arbitrator finds your claim frivolous. For claims over $10,000, cost-sharing follows the AAA Consumer Rules.
18.3 Class Action Waiver
You and Maya each waive the right to bring or participate in any class action, collective action, mass arbitration, private attorney general action, or other representative proceeding, whether in court or arbitration.
The arbitrator may not consolidate claims from more than one person or preside over any representative or class proceeding.
If the class action waiver is found unenforceable for any particular claim, that claim may proceed in court, but all other claims remain subject to individual arbitration.
18.4 Small Claims Exception
Either party may bring an individual claim in small claims court instead of arbitration, as long as the matter stays in small claims court and is brought only as an individual (not class) action.
18.5 Injunctive Relief Exception
Nothing in this section prevents either party from seeking emergency injunctive or equitable relief in court to prevent irreparable harm while arbitration proceeds.
18.6 Opt-Out Right
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with the subject line "Arbitration Opt-Out" and including your name and phone number. Opting out does not affect your right to use Maya's services.
If you opt out, disputes will be resolved in the courts described in Section 19.
19. Governing Law and Jurisdiction
The governing law, contracting entity, and jurisdiction for disputes depend on your location. See your Jurisdiction Specific Terms.
Default (United States): If no other jurisdiction-specific terms apply to you, these Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles — except that the Federal Arbitration Act governs Section 18. For matters not subject to arbitration, you consent to the exclusive jurisdiction of state and federal courts in Delaware.
20. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the "Last Updated" date at the top. For material changes, we'll give you advance notice via SMS or email where practicable.
Your continued use of Maya after updated Terms take effect means you accept the changes. If you don't agree with changes, you can stop using Maya and request account deletion at [email protected].
21. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy and any applicable product-specific terms, are the complete agreement between you and Maya about Maya's services.
Severability: If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and all remaining provisions continue in full force.
No Waiver: Our failure to enforce any provision doesn't waive our right to enforce it later.
Assignment: Maya may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without Maya's written consent.
No Third-Party Beneficiaries: These Terms are for the benefit of you and Maya only. No third party has any rights under these Terms.
