Costa Rica: Additional Terms

These additional terms apply to members whose primary location is in Costa Rica. They supplement and, in the event of any conflict, take precedence over the Maya Terms of Service.

Service Availability Notice

Maya's services in Costa Rica are currently available in limited beta. Not all service verticals are available in all regions of Costa Rica. Current service availability is communicated within the service itself.

Maya does not currently operate a local Costa Rican entity.

Governing Law

This agreement is governed by the laws of the State of Delaware, USA, except where mandatory Costa Rican consumer protection law or data protection law provides you with greater protection, in which case those mandatory provisions apply.

Dispute Resolution

The arbitration agreement in Section 18 of the Terms of Service applies to the extent permitted under Costa Rican law. Where mandatory Costa Rican consumer protection law (Ley 7472) requires access to local courts or dispute resolution mechanisms, you retain those rights.

Data Protection: Ley 8968

Costa Rican residents have rights under the Ley de Proteccion de la Persona frente al tratamiento de sus Datos Personales (Ley 8968, 2011) and its regulations. These rights include:

Right of access (ARCO rights):

  • Acceso: Request confirmation that Maya holds your personal data and obtain a copy;
  • Rectificacion: Request correction of inaccurate data;
  • Cancelacion: Request deletion of your data (subject to legal retention requirements);
  • Oposicion: Object to the processing of your data in certain circumstances.

Data Controller Registration: Maya Verdant, LLC processes personal data of Costa Rican residents and complies with applicable registration and security requirements under Ley 8968.

Consumer Protection: Ley 7472

Your rights as a consumer under the Ley de Promocion de la Competencia y Defensa Efectiva del Consumidor (Ley 7472) are not waived by these Terms. These include rights to accurate information, protection against misleading commercial practices, and access to effective remedies.

For consumer complaints, you may also contact the Comision Nacional del Consumidor (CNC) through MEIC (Ministerio de Economia, Industria y Comercio).

Pet Food: Costa Rica Specific Terms

The following terms apply to pet food products purchased through Maya by members located in Costa Rica.

Regulatory compliance: Pet food sold by Maya for delivery in Costa Rica is represented by its manufacturer or distributor as compliant with applicable Costa Rican import and food safety requirements administered by the Servicio Nacional de Salud Animal (SENASA), the agency within the Ministerio de Agricultura y Ganaderia (MAG) responsible for animal health and the safety of animal feed and pet food products in Costa Rica. Maya sells only products that are represented as meeting SENASA import and food safety requirements, but Maya does not independently audit such compliance.

Consumer right of return: Under Costa Rican consumer law (Ley 7472), members in Costa Rica have the right to return defective or mislabeled products within the applicable statutory period. If you receive a pet food product that is defective, expired, mislabeled, or otherwise does not conform to the description provided at the time of purchase, you may return it within the statutory period under Costa Rican consumer law. Mislabeling and product information: Under Ley 7472 and applicable SENASA regulations, pet food products sold in Costa Rica must carry labeling that accurately describes the product's contents, nutritional information, species suitability, and manufacturer information. If you believe a product is mislabeled or that the label does not conform to Costa Rican regulatory requirements, contact [email protected] and, if applicable, you may also report the issue to SENASA or the CNC.

Veterinary consultation: Maya does not warrant that any pet food product sold is appropriate for your specific pet's health needs. Costa Rican members are encouraged to consult a licensed veterinarian registered with the Colegio de Medicos Veterinarios de Costa Rica for dietary recommendations specific to their pet's health condition, breed, age, and weight.

Liability for pet health outcomes: Maya is not liable for adverse health outcomes resulting from a pet consuming a product that is appropriate for general sale but unsuitable for your specific pet's individual health condition. Where a product is defective, contaminated, or fails to meet applicable SENASA safety standards, liability is governed by Ley 7472 and other applicable Costa Rican law.

Import restrictions: Certain pet food products may be subject to import restrictions under Costa Rican law. Maya will only offer for sale in Costa Rica products that are, to Maya's knowledge, eligible for import. However, customs processing and final import approval are outside Maya's control. If a shipment is detained or refused at customs, Maya will work with you to resolve the issue or issue a refund.

Language of product information: Product labels and information may be in English or Spanish. If you require product information in Spanish and it is not provided on the label, contact [email protected]. In the event of any discrepancy between an English label and a Spanish translation provided by Maya, the original manufacturer's label controls.

Language

These Terms are provided in English. If you require a Spanish-language version, contact [email protected] and Maya will provide one upon request. In the event of any conflict between an English version and a Spanish version, the English version controls unless otherwise required by applicable Costa Rican law.

Currency and Pricing

Where Maya facilitates deals on products or services in Costa Rica, prices may be quoted in USD or Costa Rican Colones (CRC) depending on the transaction. Maya is not responsible for currency conversion rates or fluctuations.

Conflict Resolution

In the event of any conflict between these Costa Rica additional terms and Maya's main Terms of Service, these additional terms control for Costa Rican members.
