United Kingdom โ Additional Terms
These additional terms apply to users whose primary location is in the United Kingdom (England, Scotland, Wales, and Northern Ireland). They supplement and, in the event of any conflict, take precedence over the Maya Terms of Service.
Contracting Entity
You are contracting with:
Maya Verdant, LLC SJO-560727, #25331 Miami, Florida 33102 USA
(Maya does not currently have a UK subsidiary. If a UK entity is established, users will be notified.)
Governing Law
Your use of Maya's services is governed by the laws of England and Wales, without regard to conflict of laws principles, unless mandatory Scottish or Northern Irish law applies to you.
Dispute Resolution
The arbitration clause in Section 18 of the Terms of Service does not prevent you from bringing mandatory consumer disputes before UK courts. As a UK consumer, you retain the right to bring disputes before the courts of England and Wales (or Scottish courts if you reside in Scotland).
The class action waiver in Section 18.3 does not apply to the extent prohibited by UK consumer law, including the Consumer Rights Act 2015.
UK GDPR and Data Protection Act 2018
As a UK resident, you have the same data rights described in the EU/EEA Additional Terms (right of access, rectification, erasure, restriction, portability, and objection), applied under the UK GDPR and Data Protection Act 2018.
To exercise these rights, email [email protected] with "UK Data Request" in the subject line.
UK Supervisory Authority: You have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.
Consumer Rights Act 2015
Your statutory rights under the Consumer Rights Act 2015 are not affected or limited by Maya's Terms of Service. In particular:
- Services must be performed with reasonable care and skill
- Services must be performed within a reasonable time (if no time is specified)
- You have remedies if a service is not performed in conformity with the contract
Contracts (Rights of Third Parties) Act 1999
Nothing in Maya's Terms of Service creates rights for third parties under the Contracts (Rights of Third Parties) Act 1999. Only you and Maya are parties to the agreement.
Nature of Service
This agreement is a contract for the provision of services. The Sale of Goods Act 1979 and the Supply of Goods (Implied Terms) Act 1973 do not apply to these Terms.
Financial Services
Maya is not authorised or regulated by the Financial Conduct Authority (FCA). Maya's deal recommendations and comparisons do not constitute regulated financial advice or regulated activity under the Financial Services and Markets Act 2000. Where Maya facilitates access to financing, those services are provided by FCA-regulated lenders under their own terms.
Conflict Resolution
In the event of any conflict between these UK additional terms and Maya's main Terms of Service, these additional terms control for UK users.
